Shop Terms and Conditions

These Terms and Conditions (“Terms”) apply to visitors (“you” or “your”) of the website workoutonlocation.myshopify.com (the “Site”) and govern your relationship with Stratco (“we”, “our”, “us” or “Work-Out (Stratco)”). Please read them carefully, as they affect your legal rights and obligations.

Applicability

These Terms and Conditions (“Terms”) apply to all agreements you conclude with Work-Out (Stratco) and to all actions you take via our Site as a consumer (any natural person who purchases or uses a good or service available on the market exclusively for non-professional purposes). Please read these Terms carefully before placing your order.

Changes

We reserve the right to amend these Terms at any time. The most current version will always be available on our Site. By continuing to use our services after changes have been published, you accept those changes. Where specific additional terms apply alongside these Terms, these Terms also apply to those specific terms.

Orders and Payments

Prices

All prices are listed in euros and include all applicable taxes, VAT, levies, and services. Shipping costs and any other charges are clearly displayed before you complete your order. All prices and specifications on our Site are regularly updated and carefully checked. Although we do our best to display them accurately, we cannot be held liable for any errors or omissions. Promotions run for the stated period or while stocks last.

Payments

Payment must be made via the available payment methods on our website. We accept Visa, PayPal, Maestro, Mastercard, Google Pay, Apple Pay, and Bancontact. All payments must be fully authorised by the issuer of the credit or debit card before we process your order. If your card issuer refuses to authorise payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

Order Confirmation

After placing an order, you will receive an email confirming receipt and the details of your order. However, this does not mean your order has been accepted. We reserve the right to refuse any order for any reason. If we are unable to supply your products due to a stock error, shortage, or any unforeseen circumstance, your order (or the affected item) will be cancelled and you will be notified. A refund of the cancelled product(s) will then follow.

Our Offer

The description of our products is always sufficiently detailed to allow you to make a proper assessment. Where images are used, they are a truthful representation of the products offered. Due to technical limitations, certain colours and information may differ from reality. Errors can occur. If we have made an obvious mistake, we are not obliged to supply.

Risk

The risk of loss of, or damage to, the products passes to the customer once the products have been delivered to the delivery address provided by the customer.

Liability, Conformity and Warranty

Limitation of Liability

To the fullest extent permitted by law, we—including companies affiliated with us, our agents, and employees—exclude any liability for any loss or damage, direct and/or indirect, arising in any way from and/or connected with the use of the Site or any website linked to the Site, including (but not limited to) loss or damage arising from and/or resulting from:
• the use of the Site or the inability to use the Site;
• the use of, or reliance on, the content displayed on the Site;
• actions taken by you prompted by information posted on the Site;
• the fact that certain information on the Site is incorrect, incomplete, or not up to date.

Site Content

We do not warrant that the content of the Site is accurate, current, or complete, that the Site will operate uninterrupted, or that it will be error-free. Before taking any action (such as performing exercises) based on the content of the Site, you should seek professional or specialist advice. If the information provided contains inaccuracies, or if certain information on or via the Site is unavailable, we will use our best efforts to rectify this as quickly as possible. Conformity

Your order will meet the normal expectations you may have, taking into account the product specifications. If, within 24 months of purchase, a defect arises due to manufacturing or material faults, please contact us as soon as possible at info@workout.jarneclaesen.be. We will assess how to resolve the issue and keep you informed.

Warranty

Although we do our best to ensure our products are of high quality, we provide no warranties other than those required by law. Defects caused by accidents, negligence, improper use, and normal wear and tear are not covered by the statutory warranty.

Force Majeure

In the event of force majeure, we are not obliged to fulfil our obligations. In such a case, we may either suspend our obligations for the duration of the force majeure or terminate the agreement definitively. Force majeure includes any circumstance beyond our will and control that wholly or partially prevents the fulfilment of our obligations. This includes, among other things, strikes, fire, business interruptions, power failures, failures in a (telecommunications) network or connection or used communication systems and/or the unavailability of our website at any time, non-delivery or late delivery by suppliers or other engaged third parties, etc.

Intellectual Property

We are the owner or licensee of all intellectual property rights (including copyright and trade marks) in all texts, images, audio, software, and other materials on the Site. All such rights are reserved.

Our trade marks and logos must not be used in connection with products or services that are not ours or those of our subsidiaries, nor in any manner likely to cause confusion among customers, or in any manner that disparages us and/or our subsidiaries. All other trade marks and logos used on the Site are the trade marks or logos of their respective owners. We make no claim to third-party marks that may appear on the Site. You are not permitted to copy, distribute, or otherwise use this content without our express written consent.

Governing Law, Dispute Resolution and Complaints

Governing Law

These Terms and all agreements are governed by and construed in accordance with Belgian law. Nothing in these Terms shall be deemed to affect your statutory rights.

Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms or any agreements, both parties shall first seek an amicable settlement. If this is not possible, the Belgian courts shall have exclusive jurisdiction.

Complaints Procedure

We always hope that all our customers are 100% satisfied. If you do have a complaint about our services, you can contact us at info@workout.jarneclaesen.be. We will do everything we can to handle your complaint within 30 days. If you have not received a response from us within 30 days, please contact us again. It may happen that your emails are blocked by anti-spam filters and do not reach us, or conversely, that our reply does not reach you. If the complaint concerns a product warranty, it may take a little longer before you receive an answer from us. In such cases, we depend on the manufacturer’s response time.


For out-of-court dispute resolution, the Consumer Mediation Service of the Federal Public Service Economy is competent to receive any request for out-of-court settlement of consumer disputes.
